Domestic Abuse

Domestic violence occurs in a relationships (for example, between family members, a dating relationship, or where individuals live or have lived together) where one person threatens or inflicts physical or emotional harm, violates a personal sense of space or peace, or destroys personal property.

If you believe you are a victim of domestic violence, you may be entitled to a Domestic Violence Restraining Order. A Domestic Violence Restraining Order is a court order that protects a person from ongoing abuse. It may order the perpetrator of the domestic violence to move out of the residence, restrain him/her from telephoning or in any manner whatsoever contacting the victim(s) of domestic violence. It will also require the perpetrator to turn in any firearms he or she may have access to, among other remedies.

Unfortunately, domestic violence allegations have also become a tactic used by some litigants to gain an advantage in other aspects of a case such as in a custody dispute, or to minimize spousal support. Domestic violence restraining orders can even have an adverse effect on your custody rights, and even upon your support obligations. It may also jeopardize your job or future employment opportunities.

If you have been abused or falsely accused of committing domestic violence, you need skilled and experienced representation. We are experienced in dealing with all aspects of domestic violence and in obtaining appropriate restraining orders when necessary. Contact our office today to talk to an expert Irvine domestic violence lawyer.
